These Terms of Use ("Terms") are an agreement between you and Amitra Beauty LLC ("Amitra," "we," "us"). They apply when you use amitrabeauty.com or shop.amitrabeauty.com (the "Site") or buy our products. By using the Site or placing an order, you agree to these Terms. Please read Section 13, which requires individual arbitration of most disputes and waives class actions, and explains how to opt out.
1. Who may buy
You must be at least 18, or have a parent or guardian's permission, to place an order. We currently ship only within the United States.
2. Our products
Amitra products are cosmetics. They are not intended to diagnose, treat, cure, or prevent any disease. Our product contains essential oils, sweet almond oil, and sesame oil. Read the full ingredient list before use, patch test first, avoid contact with eyes, and stop using it if irritation occurs. Product photos are as accurate as we can make them, but color and the natural variation of small-batch botanicals mean each bottle may look slightly different.
3. Orders and pricing
Prices are in US dollars and do not include sales tax, which is shown at checkout. Shipping within the US is complimentary. Your order is an offer to buy; we accept it when we ship it. We may limit quantities, refuse or cancel an order, including for suspected fraud or an obvious pricing error, and if we cancel after you have paid, we will refund you in full.
4. Ritual Refill subscriptions
If you choose the Ritual Refill, your subscription renews automatically until you cancel, as described in our Ritual Refill Terms, which are part of these Terms.
5. Shipping, returns, and refunds
Our Shipping Policy and Refund Policy, including the 30-day Ritual Promise, are part of these Terms.
6. Intellectual property
The Amitra name, logo, product names, photography, illustrations, text, and design of the Site belong to Amitra Beauty LLC or its licensors. You may view and share pages for personal, non-commercial use. You may not copy, sell, or create derivative works from them without our written permission.
7. Reviews and content you send us
If you send us a review, photo, or comment, it must be honest and your own, and you must have the right to share it. You give us a non-exclusive, royalty-free license to display it on our Site and social channels with your first name and last initial. We will not edit a review in a way that changes its meaning, and we will not suppress reviews because they are negative. We may remove content that is unlawful, abusive, or unrelated to the product. If we gave you free product or anything of value, we will say so next to your review.
8. Acceptable use
Do not use the Site to break the law, interfere with its security or operation, scrape it with automated tools, place fraudulent orders, or impersonate anyone.
9. Third-party services
Checkout, payments, and customer accounts are provided by Shopify, and the Site links to Instagram. Their own terms and privacy policies apply to your use of those services.
10. Disclaimers
Except as stated in our Refund Policy, the Site and its content are provided "as is." To the fullest extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law.
11. Limitation of liability
To the fullest extent the law allows, Amitra Beauty LLC is not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to the Site or our products is limited to the amount you paid us for the product giving rise to the claim. This does not limit liability for our fraud, willful misconduct, gross negligence, personal injury caused by our negligence, or any liability that cannot be limited by law.
12. Indemnity
If you break these Terms or the law in using the Site, you agree to cover reasonable losses and costs we incur as a result, to the extent the law allows.
13. Resolving disputes
Talk to us first. Most concerns are resolved quickly by email. Before starting any formal claim, email support@amitrabeauty.com with your name, order number, and what you are asking for, and give us 60 days to try to resolve it.
Individual arbitration. If we cannot resolve it, you and Amitra agree to resolve any dispute relating to the Site, our products, or these Terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration may be held by video or in Monterey County, California, or in the county where you live. We will pay the filing, administration, and arbitrator fees that the AAA Consumer Rules assign to a business.
Exceptions. Either of us may bring an individual claim in small claims court, and either of us may seek an injunction in court to stop infringement of intellectual property.
No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective, or representative proceeding, to the extent the law allows. If this class waiver is found unenforceable for a claim, that claim will proceed in court and not in arbitration.
Your right to opt out. You may opt out of this arbitration agreement by emailing support@amitrabeauty.com with the subject "Arbitration opt-out" and your name within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Governing law. California law governs these Terms, without regard to conflict of law rules, and the Federal Arbitration Act governs Section 13. Any court proceeding allowed under these Terms will be in the state or federal courts for Monterey County, California, unless the law of your state requires otherwise.
14. Changes
We may update these Terms by posting a new version here with a new date. Changes apply to orders placed after the update. Changes to Section 13 will not apply to a dispute we already know about.
